Unless otherwise stated, original copies of Wills dated prior to 1858 are usually found in the appropriate Diocesan Record Office for the court where the Will was proved - for Herefordshire, this is the Hereford Record Office. Wills which were proved in the Archdeaconry of Brecon may be found at the National Library of Wales in Aberystwyth. Copies of Wills for which Probate was granted at the PCC (Prerogative Court of Canterbury) may be obtained via the National Archives Wills website.

Searches for, and Copies of Wills and Probate 1858-1996 may be obtained through via the Find a Will service, at local Registries, and sometimes on microfilm at County Record Offices. Further information on post-1858 Wills, may be found on the Government's Wills, Probate and Inheritance pages.

Abbreviations which may be used on this page are:-

(Ad) "Admon", or Letters of Administration.
(I) Inventory (a list of the deceased's goods, and their value)
(N) A Nuncupative Will is one declared by a legal representative, as being indicative
of the deceased's wishes, and will often refer to the Testator in the third person.
(#) Indicates the Will is a 'duplicate' - that is, more than one person has submitted an
abstract from the same original Will.
 * An asterisk against a surname indicates the Executor(s) of the Will, or, in the case
of Administration (Ad), the Administrator(s)
i/t/p "in the parish (of)".

His brother James GIBSON became incumbent of Wootton Underwood co Bucks and was the father of the a/m Executor James GIBSON (Jesus College, Oxford in 1712 aged 15, Rector of Hockerton, 1722). Radnor, late the Estate of Thomas EYRE Esq for 20,000£;   I have paid 15,000£ and have set apart a mortgage made by Sir John Lyster MAYE, Baronet and others for 5,000£ to the Trustees which 5,000£ is part of the sum of 6,000£ marriage settlement for benefit of me and my wife and children. If I die before the said purchase is completed following annual rents should be available for compensation:

This Will is a long complex one and the full transcription, by Barbara Childs has been much abridged. It is however especially interesting as it explains how the beneficiaries had to change their name to GREENLY to inherit the very wealthy family estates.  By the time it was sorted Sir Isaac was the late Sir Isaac, Mrs & Mrs HASTINGS were Sir and Dame HASTINGS.  Anyone researching Lady GREENLY may be interested to know she was a close friend of Augusta HALL (née WADDINGTON), Lady Llanofer, Bee of Gwent.

Hereford Gentleman 40£ sterling, and residue between and amongst Anne the wife of Josiah DAVIES of Ivington i/t/p Leominster, farmer;   Sarah the wife of John HAWKINS of Pembridge, grocer;   Jane the daughter of Mary BASSETT the wife of Thomas BASSETT of Kingsland, shoemaker;   Jane the daughter of John GREENLY the younger of Hardwicke, farmer;   and my niece Elizabeth BENNETT (her share free from the debts control or interference of her present or any other future husband).

[2] Mary BOORN (widow) married John GREENLY (widower) in Dilwyn (MX 180), 5 Oct 1826. Both marks made as crosses.
[3] John's 1st wife, Mary née HARTLAND, was mother of the GREENLY offspring. She was buried in Eardisland in 1822.

5. that cottage and garden situate at Cholstrey i/t/p Leominster called or known by the name of Brooknow in the occupation of William MORRIS - to the use of my son Richard GREENLY.
I forgive my son in law Josiah DAVIES his debt of 260£.
6. All that my piece of arable land called the lug acre in Hardwicke Field also land called Hardwicke Bank and the young orchard i/t/p Eardisland ... and messuage and lands at Sollers Dilwyn co. Hereford and my seventh part or share in messuage and lands called the hunnergalls (?) i/t/p Leominster - one sixth part to my daughter Ann the wife of the said Josiah DAVIES.
My will is my Executors to consult and employ James George WOODHOUSE of the Borough of Leominster Gentleman if an attorney is necessary.

wife Jane GARRETT - all my goods for life and then equally between the daughters of my son William GARRETT (viz Ann GARRETT and Jane GARRETT);   also to wife Jane for life the interest on my share of the money to come to me after the death of Elizabeth RUSSELL of Newnham co. Gloucester (willed to me by the late Richard RUSSELL of Newnham, Innkeeper), the principal to be laid out to best advantage by my Trustees;   also to wife Jane - the Tithe of 3 fields of approx 4ac. lying in the top of Peterchurch Field (now the property of William HANCORN), and after Jane's death equally between my son William GARRETT and my daughter Ann SIMKINS for life and then half of the principal to Ann's ch'n and half (plus the Tithe) equally between William's 2 daughters a/n.
Trustees: Mr John GWYN Saddler, Harness Maker and Innkeeper,   and William DAVIES Shoemaker, both of Peterchurch. No Executor appointed.

Proved London PCC 23 Apr 1856 after William HOWARD of Peterchurch, carpenter  swore 11 Apr 1856 he'd witnessed the Will's signing. Admon granted to  William DAVIES, surviving Legatee.
Notes: Thomas GARRETT was baptised 5 Aug 1774 at Peterchurch and was described as "Ag Lab" in 1841 aged 66; in 1851 he was aged 78, an Annuitant, living with his son William at Castle Cwm, Peterchurch. He mar Jane WEAVER (b. Garway) on 8 Aug 1800 at Peterchurch by Licence; their son William was b. 2 Feb 1804 & bap 20 Mar 1804.
William GARRETT was a Farmer in 1851 & 1861; he and his wife Celia had 2 daughters - Ann b. c1845 in St Margarets and Jane b. c1848 in Abbeydore.

lately deceased wife;   my M/S and another Settlement between me and my said wife after the death of her uncle John Moore GREEN Esquire[1] will result in my 2 daughters Amelia Ann HORN (wife of Henry HORN esq) and Arabella Emma (wife of Edward David THOMAS esq) being entitled to various estates in co. Hereford and co. Essex;   my son-in-law Edward David THOMAS is already in possession of his paternal estates (with the mansion called Wellfield near Builth co. Radnor) so Amelia to have Cagebrook House and to live there with Henry HORN… I also give her 3 parcels of land recently bought from John Holder MATTHEWS esq which are near Cagebrook and all other lands not otherwise disposed, also R&R.
